Command Cooking LLC (together with its parent company(ies), subsidiaries, and affiliates, "Command Cooking," "us," "we," or "our") is committed to advising you of the right to your privacy. This Privacy Policy (the "Privacy Policy") describes the types of personal information we collect and how we use and share that personal information and the choices you have regarding such use and sharing.

When the Privacy Policy Applies

The Privacy Policy applies to the personal information collected in connection with the Command Cooking email newsletters, the websites that we own and operate that link to this Privacy Policy (collectively, the "Site"), and the personal information we collect in connection with our related services and features (collectively all referred to as the "Platform" in this Privacy Policy).

How We Collect Personal Information

Sources of Personal Information

Generally, we as well as third-party vendors, networks, ISP(s), and supporting advertisers may collect information about you from several sources, including:

Directly From You. We will collect the personal information that you provide when you provide it to us, such as when you fill out one of our surveys, send us a message, or otherwise provide your personal information. Our advertisers and other partners may also collect personal information directly from you if you enter it into one of their surveys or in connection with one of their sweepstakes. Any personal information collected by a third party will be subject to that party's privacy policy.
From Third Parties. Third parties may also provide us with personal information about you, such as data providers/licensors, social media platforms, our advertising partner, data analytics service providers, or sweepstakes/contest providers. We may merge or combine the personal information that we receive about you from third parties with personal information that we collect directly or via automatic means.
Automatic Collection. We, our service providers, and our advertising partners collect personal information about you or your device (including computers or mobile devices) automatically when you interact with the Platform, including through the use of technologies such as cookies, web beacons, javascript applications, or other tracking technologies. This information includes the online activity and device information described below in the subsection titled "Types of Personal Information Collected," which may be collected over time on our Platform and on other online sites and services. The technologies used may include:

Cookies. These are small text files that websites and online services store on a visitor's device/browser to uniquely identify the visitor or store other relevant information or settings. Cookies may be used for various purposes, including for the purpose of helping navigation across we pages, enabling different types of functionality, recording usage, activity, and patterns, remembering preferences, and supporting online advertising.
Local Storage. Local storage occurs in the browser and allows a larger capacity of storage on a device than cookies. Local storage is used for similar reasons, such as storing and remembering preferences (including multimedia preferences), measuring the effectiveness of advertisements, and customizing features of websites.
Flash Cookies. Flash cookies are similar to cookies, but allow storage of a larger amount of data with storage that usually lasts longer than regular cookies. These are sometimes called locally-stored objects. Flash cookies are used for similar purposes as cookies.
Pixel tags. Pixel tags are small images or pieces of code placed on a website or in an email. These are sometimes also called web beacons or clear GIFs. Pixel tags are typically used to track when an email or certain content in an email or on a web page was viewed or clicked, and often used to compile statistics about usage or to help track the success of advertising campaigns.
Session-Replay Technologies. These technologies are third-party services that operating on a website or platform to record a "video replay" of a user's session on a website or platform. The replay may include actions like clicks, mouse movements, scrolls, typing, and other activity. Replays are used for things like troubleshooting problems with a website or platform, understanding how users are interacting with a website or platform, and identifying areas for improvement.

Friends and Other Referrers. Sometimes, our users may refer friends or other contacts to us and share their contact information. Please do not provide us with someone's contact information unless you have their permission to do so.

Types of Personal Information Collected

Examples of the categories of personal information that may be collected in connection with the Platform include the categories listed below. Sometimes we collect combinations of these types of information:

Contact Information. Information that can be used to contact you. Examples include your name, email address, or social media profile name.
Demographic Information. Information about selected population characteristics. Examples may include your zip code, city, state, age, gender, salary range, education, marital status, occupation, military service, industry of employment, or personal and online interests.
Online or Network Activity Information. Information which is automatically collected when you use or interact with the Platform. Examples may include areas of the Platform that you visit, what services you access or view, the website or service where you clicked from to visit the Platform, times that you access the Platform and duration of access, other websites you have visited (such as the website or service where you clicked to visit our Site), and other information about your activity.
Device Information. Like Online or Network Activity Information, information which is automatically collected when you use or interact with the Platform. Examples may include information about your computer or device hardware and software, IP address (and related geographic location), browser preference, operating system type and version number, domain names, wireless carrier, device identifier (such as common advertising IDs, like Apple ID for Advertising or Google Advertising ID), or screen resolution.
Account Information. Information provided in connection with an account on the Platform if we offer such functionality for any services you use. Example may include profile details, registration data, or settings.
User Content. Information users may submit or post to the Platform. Examples may include text, images, audio, or video, along with the metadata associated with any files.
Marketing Choice Information. Information about your marketing preferences. Examples may include any unsubscribe or opt-outs you submit, preferences for receiving our newsletters, or details about how you engage with our communications.
Your Responses. Information you provide when interacting with our surveys, sweepstakes, contests, or other similar features. Examples depend on the relevant feature and may include your opinions, views, or other personal information you choose to provide.

We do not knowingly collect information from anyone under the age of 18. If we obtain actual knowledge that we have collected personal information about a person under the age of 18, we will delete that personal information from the database.

How We Use Personal Information

We will use the personal information collected for the purposes below, as described in this Privacy Policy, or as described or apparent at the time of collection.

Providing the Platform and Operating Our Business

We may use personal information to provide our Platform and operate our business, such as when we use your personal information to:

Provide, maintain and improve the Platform;
Provide and deliver the services or features you request and send you related information, including confirmations and notifications;
Send you technical notices, updates, security alerts and support and administrative messages;
Respond to your comments, questions and requests and provide customer service;
Communicate with you about products, services, offers, promotions, and rewards offered by us and others, and provide news and other information we think may be of interest to you;
Process and deliver contest entries and rewards;
Link or combine with information we get from others to help understand your interests and provide you with better service; or
Personalize and improve the Platform and provide content or features that match user interests.

Research and Development

We may use personal information for research and development purposes, such as to:

Monitor and analyze trends, usage and activities in connection with the Platform;
Assess the success of our marketing campaigns;
Create business and marketing reports; or
Develop new services, features, content, or otherwise improve our business and the services we offer.

As part of these activities, we may create anonymous, aggregated, or de-identified data from personal information by removing information that makes the data personally identifiable. We may use this anonymous, aggregated, or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Platform and promote our business. To the extent that we classify such information as "de-identified," we commit to maintaining and using such information in a de-identified form and to not attempting to re-identify such information (except for purposes permitted by law).

Compliance and Safety Purposes

We may use personal information for purposes of compliance and other safety, fraud prevention, security, and safety purposes, such as to:

Detect, investigate and prevent fraudulent transactions and other illegal activities (including, for example, cyberattacks or identity theft) and protect the rights and property of us and others;
Comply with applicable laws or other legal requests, such as subpoenas or requests from authorities;
Promote the security, integrity, resilience, and protection of the Platform and our systems, applications, networks, databases, and other technology assets;
Auditing and compliance reviews; or
Enforce our contracts and the terms governing the Platform, including by making and defending legal claims.

Advertising

We, our advertising partners, and our service providers may use personal information to display, serve, and deliver ads that may be of interest to you based upon personal information collected about you over time on the Platform and across other channels. These channels may include online settings, such as websites, online platforms, social media networks, or addressable TV, as well as offline settings, such as purchases made at a store. Personal information may be used, for example:

To show you more relevant advertising, whether through our own services and Platforms, or on third-party services and websites;
Advertise to you directly and indirectly through partner networks, including appending and/or merging information for the purpose of advertising to you on our service as well as other services such as Facebook or Google;
By advertising partners or social media platforms to deliver ads to you on their platform, or to develop lookalike audiences by delivering ads to similar users on their platform; or
Optimize ad campaigns or conduct market research.

The information used for these purposes is typically collected through cookies, pixels, and similar tracking technologies, as further described above in the section titled "Automatic Collection." All or partial advertising on this Platform is managed by Playwire LLC. If Playwire publisher advertising services are used, Playwire LLC may collect and use certain aggregated and anonymized data for advertising purposes. International Transfer of Personal Information

We and our service providers may transfer your personal information to, or store or access it in, other countries where the laws may not provide levels of protection for your personal information equivalent to the protection provided by the laws of your home country.

We may share personal information in the following circumstances or as otherwise specified in this Privacy Policy:

With vendors, consultants and other service providers who need access to such information to carry out work on our behalf, including providing you with the products and services you request, interact with, and to which you subscribe;
With authorities and others, in response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation, or for the other compliance, safety, and fraud prevention purposes described in this Privacy Policy, such as to protect our property or rights or the safety of our employees, our customers, or other individuals;
With business transaction participants, in connection with, or during negotiations of, any merger, sale of company assets, financing, consolidation, reorganization, divestiture, change of control, dissolution, bankruptcy or similar proceedings, or acquisition of all or a portion of our business to another company;
With our affiliated entities (including parent companies and other entities under common control), which may include for their own and/or their clients' marketing activities;
With our professional advisors, such professional firms offering us legal, tax, accounting, or other professional services, where necessary as part of the services we are receiving;
With advertising partners, including data aggregators and ad networks, for the advertising and other purposes described in this Privacy Policy;
With sweepstakes and other business partners, such as companies that we partner with to host a promotion or giveaway; and
Other users and the public, such as when you post a comment otherwise provide user content to the Platform for display or use by others. This includes, for example, information contained in any quizzes or comments you post. Information about your achievements may also be publicly shared, such as through our leaderboard page. Please note that we do not control how other users or third parties use any personal information that you make available to the public or one or more users.

Third Party Links and Websites

Our Platform and email messages sometimes contain hypertext links to websites owned by third parties. We are not responsible for the privacy practices or the content of such other websites. These links are provided for your convenience and reference only. We do not operate or control any information, software, products or services available on these third-party websites. The inclusion of a link on our Platform does not imply any endorsement of the services, products or website, or its sponsoring organization.

Your Choices

You can make the following choices regarding your personal information.

Review and Request Changes to Your Personal Information. If you have an account, you may review and update available information and preferences.

Opt-Out of Marketing Emails. You may opt-out of marketing-related emails by clicking the "unsubscribe" link at the bottom of the email or by contacting us as provided at the end of this Privacy Policy. You may still receive service-related and other non-marketing communications.

Control Cookies & Browser Web Storage. To control cookies, your browser may allow you to clear or block cookies from the websites you visit, or clear your browser web storage. Follow the instructions in your browser's settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and it may not work properly. Google Analytics. The Site may use Google Analytics to help us analyze how the Site is being accessed and used. Advertising Choices. To limit the use of your personal information for targeted advertising, you can make selection by clicking "Your Privacy Choices" in the footer of our Site or take actions including blocking third-party cookies in your browser settings, using browser plug-ins/extensions, and using your mobile device settings to limit the use of the advertising ID associated with your mobile device. You can also opt out of interest-based ads from our advertising partners who participate in the following industry opt-out programs by visiting the linked websites: the Network Advertising Initiative and the Digital Advertising Alliance. In addition, some of the companies we work with may offer their own opt-out mechanisms.

Many of the opt-out preferences described in this section must be set on each device and/or browser for which you want them to apply. Please note that some of the advertising companies we work with may not participate in the opt-out mechanisms described above, so even after opting-out, you may still receive targeted advertisements from other companies. If you opt-out of targeted advertisements, you will still see advertisements online but they may be less relevant to you.

Notice to Non-US Users

The Platform is published in the United States and intended only for US users. We attempt to protect the personally identifiable information of all users of our Platform and we attempt to comply with local data protection and consumer rights laws to the extent they may apply to the Platform, but our Platform is targeted to United States citizens and our policies are directed at compliance with those laws. If you are uncertain whether this Privacy Policy conflicts with the applicable local privacy laws where you are located, you should not utilize the Platform or provide any personal information.

If you are located outside the United States, you should be aware that your personally identifiable information will be transferred to the United States, the laws of which may be deemed by your country to have inadequate data protection. If you are located in a country outside the United States and voluntarily submit personally identifiable information to us, you thereby consent to the general use of such information as provided in this Privacy Policy and to the transfer of that information to, and/or storage of that information in, the United States.

How We Protect Your Information

We take our responsibility to secure the information we collect and maintain seriously. We use reasonable security, including technical, physical and administrative controls, to secure the information we collect and maintain. However, we cannot guarantee that these practices will prevent every unauthorized attempt to access, use, or disclose information. You can help protect the privacy of your own information by using encryption and other techniques to prevent unauthorized interception of your personal information. You are responsible for the security of your information that you transmit to us or view, download, or otherwise access when using unencrypted, public or otherwise unsecured networks. Children

The Platform is not intended for use by anyone under the age of 18, and we do not knowingly collect personal information from children under 18.

Notice for California Residents

This section applies only to California residents and "personal information" covered by the CCPA, and supplements the information provided elsewhere in this Privacy Policy. It describes how we collect, use, sell, share, and retain personal information of California residents in operating our business, and their rights with respect to their personal information under California law, including the California Consumer Privacy Act of 2018 (the "CCPA").

Personal Information Collected and the Purposes of Collection and Use

The categories of personal information we collect (and have collected in the preceding 12 months) under the CCPA are described below. For more information about each of the examples listed here, please refer above to the section titled "Types of Personal Information Collected."

Identifiers, including Contact Information, User Content, Account Information, Your Responses, and Device Information.

Protected Classifications, to the extent such classifications are revealed through Your Responses, Demographic Information, Account Information, or User Content.

Sensory Information, to the extent incorporated into User Content.

We describe:

the business or commercial purposes for which we collect and share each of the categories of personal information in the section above titled "How We Use Personal Information."

To the extent we collect sensitive personal information (as defined under the CCPA), we only use or disclose it for purposes permitted under the CCPA (e.g., to provide the Platform, detect security incidences and prevent fraud, and to verify and maintain the quality of the Platform). We do not collect or use sensitive personal information for the purpose of inferring characteristics about California residents.

Personal Information Disclosed for Business Purposes, "Sold," or "Shared”

We may disclose, and in the past 12 months may have disclosed each category of personal information listed above for the business purposes described throughout this Privacy Policy to our vendors, consultants, and other service providers; to authorities and others for compliance and safety purposes; business transaction participants; our affiliated entities; our professional advisors; and other users and the public (if applicable). Each of these disclosure partners are more fully described in the section above titled "Sharing of Personal Information." In addition, while most disclosures of personal information to our advertising partners or our sweepstakes/business partners are for commercial purposes, in some cases these disclosures are also made for business purposes, such as when an advertising partner uses personal information they collect through pixels in our emails to audit how many subscribers clicked on an advertisement in one of our newsletters.

In addition, we may "sell" or "share" (and in the past 12 months may have "sold" or "shared") your Identifiers, Customer Records, Commercial Information, Internet or Network Information, and Inferences to the following categories of third parties, as described in more detail in the section above titled "Sharing of Personal Information": our affiliated entities, advertising partners, and sweepstakes and other business partners.

These disclosures to third parties are called "selling" or "sharing" under the CCPA because we are either sharing your personal information in exchange for some sort of valuable consideration (monetary or otherwise), or because such disclosure is for purposes of cross-context behavioral advertising.

We do not knowingly sell or share the personal information of California residents under 16 years of age.

Retention of Personal Information

We will retain your personal information for as long as necessary to fulfill the purpose of collection, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish and defend legal claims, for fraud prevention purposes, or as long as required to meet our legal obligations. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Your California Privacy Rights

In addition to the choices enumerated elsewhere in this Privacy Policy, California residents have the rights listed below. Please note, these rights are not absolute, and, in some cases, we may not be able to respond to your request, such as when a legal exemption applies or if we are not able to verify your identity.

Right to Know/Access Personal Information.

You have the right to request that we disclose to you:
1. The categories of personal information that we have collected about you.
2. The categories of sources from which we collected personal information about you.
3. The business or commercial purpose for collecting, selling, or sharing your personal information.
4. The categories of your personal information we sold or disclosed for a business purpose.
5. The categories of third parties to whom we sold or disclosed your personal information for a business purpose.
6. The specific pieces of personal information that we have collected about you.
You may submit a verifiable consumer request to exercise your right know/access and to obtain the specific personal information we have collected about you either by emailing us at privacy@comedybriefs.com with "CCPA Request" in the subject line or by telephone at (800) 542-0892.
Upon receiving your information, the CCPA requires that we verify that you are the same consumer with whom we have the information in our systems. We may require that you verify your identity by clicking on a link we will send to the email address we have for you in our system. We may also ask you to provide information that we can match to personal information that we have previously collected about you.

Right to Request Correction of Personal Information.

You have a right to request the correction of inaccurate personal information that we maintain about you.
You may submit a verifiable consumer request to exercise your right to correction by emailing us at privacy@comedybriefs.com with "CCPA Request" in the subject line or by telephone at (800) 542-0892.
Upon receiving your request we may need to verify your identity, as further described above.

Right to Request Deletion of Personal Information.

You have a right to request the deletion of your personal information that we have collected from you.
You may submit a verifiable consumer request to delete your information by sending an email to privacy@comedybriefs.com with "CCPA Request" in the subject line or by telephone at (800) 542-0892.
Upon receiving your request we may need to verify your identity, as further described above.

Right to Opt-Out of the Sale or "Sharing" of Personal Information.

You have the right to opt-out of any sale or sharing of your personal information for purposes of cross-context behavioral advertising.
You can request to opt-out of the "sale" or "sharing" of your personal information in connection with cookies and similar technologies that we use on the Site by clicking on the "Your Privacy Choices" link at the bottom of the Site, or by broadcasting the Global Privacy Control signal. Note that due to technological limitations, if you visit our Site from a different computer or device, or clear cookies on your browser that store your preferences, you will need to return to the Site to select your preferences or rebroadcast the GPC signal.
If you direct us not to "sell" or "share" your personal information, we will consider it a request pursuant to California's "Shine the Light" law to stop sharing your personal information covered by that law with third parties for their direct marketing purposes.

Right to Non-Discrimination for the Exercise of a Consumer's Privacy Rights.

You have a right not to receive discriminatory treatment by us for the exercise of these privacy rights conferred by the CCPA. As such, we will not deny you goods or services, charge you different prices or rates for goods or services, or deny you discounts or other benefits; nor will we provide you a different level or quality of goods or services or recommend a different level or quality of goods or services.
Consistent with the CCPA, you may also designate an authorized agent to make a request on your behalf. If you do so, we may require proof of your identification, the authorized agent's proof of identification, evidence of valid permission for the authorized agent to act on your behalf, and any other information that we may request in order to verify the request. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee or decline to comply with your request if your request is clearly unfounded, repetitive, or excessive.
We make every effort to respond to a verifiable consumer request to know/access, correct, or delete within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing, and may continue to update you regarding the progress of our response.

California Notice of Financial Incentive

We may offer certain financial incentive programs that can result in different levels or quality of services to you, provided that such programs are reasonably related to the value of your personal information to us. For example, we may offer additional content to users who sign up for our mailing list, giveaways, sweepstakes, contests, or other similar promotional campaigns. We typically ask you to provide your email address or other contact information in order to participate in these programs or campaigns.

We offer these programs and campaigns because, among other things, the value of your personal information to us is related to the value of the free or discounted services, or other benefits that you obtain or that are provided as part of the applicable program or campaign. This value is based on the expense related to offering those services and benefits to participants, along with other factors such as whether and to what extent you take advantage of (or opt-out from) any offerings and whether we are able to use the data we collect from you.

When we offer any program or campaign, there is no obligation to opt-in, and you may withdraw at any time by contacting us using the designated method set forth in the applicable program rules or in the "Contact Information" section of this Privacy Policy. Notice to Nevada Residents

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the "sale" of certain types of personal information. Subject to several exceptions, Nevada law defines "sale" to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your "sale" opt-out rights, you may submit a request to us using the contact information listed at the end of this Privacy Policy with the subject line "Nevada opt-out request."

U.S. State Privacy Laws Addendum

Certain U.S. states may also provide you with additional rights under their privacy laws, such as Colorado, Virginia, or Delaware. To the extent such laws apply, this section describes how we collect, use, and share personal information of such residents, and their rights with respect to their personal information. For purposes of this section, "personal information" means "personal data" or "personal information" as such term is defined under applicable state privacy law but does not include information exempted from the scope of such laws.

Personal Information Disclosed, "Sold," or Used for "Targeted Advertising"

We may have disclosed each category of personal information that we process to the third parties listed in the "Sharing of Personal Information" section above to operate our business and for the purposes described throughout this Privacy Policy or at the time of collection.

We may also "sell" or use for "targeted advertising" Contact Information, User Content, Account Information, Your Responses, Device Information, Online or Network Activity Information, other data collected by automated means, and inferences that we create based upon these categories to the following categories of third parties, as described in more detail in the section above titled "Sharing of Personal Information": our affiliated entities, advertising partners, and sweepstakes and other business partners.

These disclosures may be called "sales" under applicable U.S. state privacy laws because we are sharing your personal information in exchange for some sort of valuable consideration. Your Privacy Rights

In addition to the choices elsewhere in this Privacy Policy, residents of states with applicable state privacy laws may request the rights listed below. Please note, these rights are not absolute and, in some cases, we may not be able to respond to your request, such as when a legal exemption applies or if we are not able to verify your identity.

Right to Access. You can request that we confirm whether we process your personal information, information about the third parties who may receive such personal information, and to access that personal information, including in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity.
Right to Correct. You can request that we correct inaccurate personal information that we maintain about you.
Right to Delete. You can request that we delete personal information provided by or obtained about you.
